Noxentry General Terms and Conditions (AGB)

These General Terms and Conditions (AGB) govern your use of the Noxentry mobile app and any related services (the "Service") provided by the controller named in the Imprint.

1. Scope

These AGB apply to every use of the Service. By creating an account or otherwise using the Service you accept these AGB in the version in force when you create your account; later changes are governed by Section 10 (Changes to these AGB).

2. Account and user responsibilities

You must be at least 16 years old to use the Service. You are responsible for keeping your login credentials confidential and for all activity carried out under your account. You must provide accurate registration data and update it as necessary.

3. Conduct rules (DSA Art. 14)

You must not upload, post, or transmit any content that is unlawful under EU or German law, including but not limited to: incitement of hatred (§130 StGB), defamation (§§185-187 StGB), violation of personal honour, content sexualising minors, or threats. You must not harass other users, impersonate other persons, attempt to circumvent our moderation, or use the Service for spam.

4. User-generated content and image rights

Photos and videos of identifiable persons may not be uploaded without that person's consent (§22 KunstUrhG / Recht am eigenen Bild). You retain ownership of the content you upload. You grant Noxentry a non-exclusive, royalty-free licence to host, store, display, and transmit your content for the sole purpose of operating the Service. Publishing an alert makes any attached photo or video publicly visible to other users on the map; you confirm you hold all necessary rights (including under §22 KunstUrhG) for any identifiable person shown, and you are responsible for claims arising from content you upload. The licence extends to the hosting and content-delivery providers we use to operate the Service and survives only as long as needed to remove the content from active systems and backups.

5. Content moderation

We may remove, restrict, or refuse to publish content that we reasonably believe violates these AGB, applicable law, or our community guidelines. We provide a notice-and-action channel and an appeal channel for affected users in accordance with DSA Arts. 16, 17, and 20. To report illegal content or appeal a moderation decision, contact support@noxentry.de; we will inform you of the outcome and the reasons for it.

6. Automated content moderation

Submitted alerts pass through an automated content classifier. Automated moderation is best-effort. If our system or a network outage prevents a check from completing, the submission may be allowed through; the user-driven report channel remains the authoritative path. You have the right to request a human review of any automated block (GDPR Art. 22(3); DSA Art. 17); send appeal requests to support@noxentry.de.

7. No emergency service

Noxentry is NOT an emergency-call service. In a life-threatening situation, dial 112 (EU) or your local emergency number directly. Safety alerts shown in the Service are user-generated and are not verified. We give no warranty of accuracy, completeness, or timeliness. This does not exclude or limit our statutory liability for intent or gross negligence, for injury to life, body or health, or under the Product Liability Act; see Section 8 (Liability).

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act (ProdHaftG). For slightly negligent breaches we are liable only where a material contractual obligation (Kardinalpflicht) is breached, and then only for the typical, foreseeable damage. Any further liability is excluded.

9. Termination

You may terminate your account at any time via Profile > Account > Delete account. We may suspend or terminate access in the event of material breach of these AGB, applicable law, or a court / regulatory order. Statutory rights of extraordinary termination remain unaffected.

10. Changes to these AGB

We may amend these AGB. Material changes will be communicated in-app at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

11. Governing law and jurisdiction

These AGB are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of the user's habitual residence remain unaffected.

12. Severability

Should any provision of these AGB be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. In place of any invalid or unenforceable provision, the applicable statutory rules shall apply (§306 BGB).

13. Diagnostic and error data

To keep the Service stable and secure, we collect crash and error diagnostics via PostHog, a provider hosted in the EU. This is limited to technical error information, it is not product-usage tracking, advertising, or profiling, and is processed on the basis of our legitimate interest (Art. 6(1)(f) GDPR).
